1. Acceptance of the Terms

These Terms of Service (the "Terms") govern your access to and use of the FitBalkanMate mobile application (the "App") provided by FitBalkanMate ("we", "us"). By downloading, installing or using the App you confirm that you have read, understood and accept these Terms and our Privacy Policy. If you do not accept the Terms, do not use the App.

You must be at least 13 years old to create an account.

2. Description of the Service

FitBalkanMate is a fitness and nutrition application that offers:

• AI coach (chat) with personalized advice;
• AI-generated workout programs;
• food recognition from photos with calorie and macronutrient calculation;
• barcode scanning for nutrition information;
• tracking of calories, macros, weight, body measurements and water intake;
• progress charts and statistics;
• a food database optimized for Balkan cuisine;
• a Bulgarian and English interface.

3. Account and user responsibilities

• You are responsible for the accuracy of the data you enter in your profile and for keeping your device secure.
• One account is intended for personal use by a single individual.
• You must notify us immediately if you discover unauthorized access to your account.
• We are not liable for data loss caused by unauthorized access resulting from your negligence.

4. Acceptable use

When using the App you agree NOT to:

• violate applicable law or the rights of third parties;
• use the AI features to create unlawful, offensive, discriminatory or harmful content;
• attempt to gain unauthorized access to our systems, disrupt or circumvent technical protections;
• copy, decompile, reverse engineer or create derivative works of the App except as permitted by law;
• automate access (scraping, bots) or overload our infrastructure;
• sell, transfer or share your account with third parties;
• upload photos you have no rights to, including photos of other people without their consent.

Payments are processed entirely through Apple App Store or Google Play. Prices shown on our website are base prices (excluding VAT). The final price at checkout may include local VAT depending on your country. Prices may change with appropriate notice in the store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.

6. Free trial period

The Premium plan can be tried with a 7-day free trial offered via the App Store / Google Play:

• The trial is available only once per user and per store account.
• If you do not cancel before the 7-day period expires, you will be charged automatically according to the selected plan.
• Cancellation is done through the subscription settings of your Apple ID or Google Play account — the steps are described in our Refund Policy.

7. Cancelling your subscription (cancel anytime)

You can cancel your subscription at any time through the store settings (Apple App Store or Google Play). After cancellation you keep access to Premium features until the end of the already paid period. The unused portion of the period is not refundable unless required by law.

8. Intellectual property

The App, its design, logos, texts, graphics, software and all content are owned by FitBalkanMate or its licensors and are protected by copyright and trademark laws. You receive a limited, non-transferable, revocable right to personal use of the App under these Terms. Data you enter (photos, records, diaries) remains your property; you grant us a limited right to process it for the purposes of the service.

10. Limitation of liability

The App is provided "as is" and "as available". To the maximum extent permitted by law, FitBalkanMate is not liable for:

• indirect, incidental, special or consequential damages;
• loss of data, profit or opportunities;
• inaccuracies in AI-generated content, including calorie and macro calculations;
• service interruptions due to technical problems or issues at third-party providers;
• results of your physical activity or diet.

Nothing in these Terms excludes liability that cannot be excluded by law.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or restrict your access in case of gross or systematic breach of these Terms, with prior notice where practically possible.

12. Changes to the Terms and the App

We may update the Terms and the features of the App. For material changes we will notify you in the App. Continued use after they take effect means acceptance.

13. Governing law and dispute resolution

• For users in the EU these Terms are governed by Bulgarian law and applicable EU acts, incl. Regulation (EU) 2016/679.
• Disputes are resolved by the competent courts of the Republic of Bulgaria; consumer individuals may also apply to the court of their permanent address where permitted by law.
• Online dispute resolution for EU consumers: the European Commission ODR platform, as well as the General Consumer Commissions (Republic of Bulgaria).

If any provision is found invalid, the remainder of the Terms continues to apply.
